Ace AI Acceptable Use Policy

1. Purpose and Scope
This Acceptable Use Policy ("AUP") governs your use of Follow Up Ace (also referred to as "Ace AI"), provided by Moon Sherpa Labs ("we", "us", or "our"), as an embedded application within the Follow Up Boss CRM platform. This AUP applies to all users of the service, including individual users, team members, and administrators. It supplements our Terms of Service and Privacy Policy. By using Ace AI, you agree to comply with this AUP.
The purpose of this policy is to ensure that Ace AI is used responsibly, ethically, and in compliance with all applicable laws, including federal and state fair housing laws, real estate licensing requirements, consumer protection regulations, and AI transparency standards. We are committed to providing a platform that empowers real estate professionals while safeguarding consumers and the integrity of the real estate industry.
2. Prohibited Uses
You may not use Ace AI for any purpose that is unlawful, harmful, or otherwise objectionable. The following activities are expressly prohibited:
2.1 Fair Housing Violations
You must not use Ace AI in any manner that violates the Fair Housing Act, the Equal Credit Opportunity Act, or any applicable state or local fair housing laws. Specifically, you must not:
- Use AI-generated communications or analysis to discriminate against any person based on race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, or any other protected class under federal, state, or local law.
- Use Ace AI to steer prospective buyers or renters toward or away from specific neighborhoods, communities, or properties based on the demographics of those areas or the characteristics of the individuals.
- Use AI tools to engage in redlining or any practice that restricts housing opportunities based on the racial or ethnic composition of a geographic area.
- Generate, send, or automate any marketing materials, communications, or lead scoring criteria that target or exclude individuals based on protected characteristics.
- Use Ace Trove scoring, profiling, or contact analysis features to make discriminatory determinations about leads or clients.
- Use Ace Trove scores or any targeting feature to deprioritize, rank against, or exclude leads or contacts on the basis of a protected class or a known proxy for a protected class — including, for example, demographic "lookalike" audiences or ZIP-code-only targeting.
- Describe the property, not the intended occupant. Listing copy, advertisements, and outreach must describe the property and its features, not the people you expect or prefer to live there. Prohibited examples include "perfect for a young family," "safe neighborhood," and "walking distance to churches." You must review every AI-generated communication before sending to confirm it complies with fair housing law.
2.2 Spam and Unsolicited Communications
- You must not use Ace AI to send unsolicited bulk messages, including emails, text messages, or any other form of communication, in violation of the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), or any applicable anti-spam laws.
- You must not use AI-generated content to create or distribute spam or deceptive marketing communications.
- All automated communications sent through or drafted by Ace AI must comply with applicable opt-in and opt-out requirements.
- You must not route AI-generated voice into outbound telephone calls to consumers, or auto-send AI-generated voice or messages, without first obtaining the consents the TCPA requires (AI/artificial voices are treated as "artificial or prerecorded" voices).
- You are the "caller" and "sender." For any call, text, or email you originate, schedule, or automate through the Service, you — not Moon Sherpa Labs — are the TCPA "caller" and the CAN-SPAM "sender" and are solely responsible for compliance. You must obtain and retain documented prior express consent before sending; honor opt-out keywords (stop, quit, end, unsubscribe) within ten (10) business days; include a valid physical postal address on every commercial email; provide a working, conspicuous unsubscribe mechanism; ensure no email subject line or header (including any AI-generated subject line) is deceptive; and review all AI Output before it is sent.
2.3 False or Misleading Content
- You must not use Ace AI to generate false property listings, fabricated property details, misleading market data, or any other deceptive content.
- You must not present AI-generated content as human-authored when disclosure of AI involvement is required by law, regulation, or professional standards.
- You must not use Ace AI to create fake reviews, testimonials, or endorsements.
- You must not manipulate or falsify data within Follow Up Boss through Ace AI integrations.
2.4 Harassment and Abusive Communications
- You must not use Ace AI to generate, send, or facilitate threatening, harassing, abusive, defamatory, or intimidating communications to any person, including leads, clients, colleagues, or members of the public.
- You must not use the voice chat or messaging features to engage in any form of verbal abuse or harassment.
- You must not use AI tools to stalk, monitor, or surveil any individual without their knowledge and consent.
2.5 Circumventing Service Limits
- You must not attempt to circumvent, bypass, or manipulate message limits, rate limiting, usage quotas, or any other service restrictions imposed by Ace AI.
- You must not use automated tools, scripts, or bots to artificially inflate usage or bypass throttling mechanisms.
- You must not create multiple accounts or use shared accounts to evade usage limits or billing restrictions.
2.6 Unauthorized Data Extraction and Scraping
- You must not use Ace AI, including its MCP (Model Context Protocol) integrations, to scrape, extract, or harvest data beyond the intended use of the service.
- You must not use Ace AI to systematically download, copy, or export CRM data for purposes unrelated to your legitimate real estate business activities.
- You must not use API access or MCP tools to build competing products or services.
2.7 Credential and Token Sharing
- You must not share your Ace AI account credentials, login information, or MCP authentication tokens with any unauthorized person or third party.
- You must not transfer, sell, or distribute your MCP tokens or API keys.
- You are responsible for maintaining the confidentiality and security of your account credentials. Any activity that occurs under your account is your responsibility.
2.8 Unlicensed Real Estate Activity
- You must not use Ace AI to conduct real estate brokerage, sales, leasing, or property management activities in any jurisdiction where you are not properly licensed or authorized to do so.
- You must not use AI-generated content as a substitute for the professional judgment and oversight required by your real estate license.
- You must comply with all continuing education and disclosure requirements applicable to your license when using AI tools in your practice.
- Users in regulated occupations (for example, Utah real-estate licensees under the Utah AI Policy Act) may have their own proactive duty to disclose the use of generative AI in consumer-facing communications. You are responsible for identifying and meeting any such disclosure obligations that apply to you.
2.9 AI System Exploitation
- You must not attempt to extract, reverse-engineer, or reconstruct AI training data, system prompts, model weights, or any proprietary AI configurations used by Ace AI.
- You must not attempt to "jailbreak" or manipulate AI models through prompt injection, adversarial inputs, or other techniques designed to circumvent the system's built-in safeguards, including compliance guardrails.
- You must not use Ace AI to generate content intended to deceive other AI systems.
2.10 Misuse of AI-Generated Content
- You must not present AI-generated content as professional legal advice, financial advice, tax advice, or any other form of professional counsel that requires appropriate licensure or certification.
- You must not rely on AI-generated property valuations, market analyses, or investment recommendations as the sole basis for financial decisions or representations to clients.
- You are responsible for reviewing and verifying all AI-generated content before using it in client communications, marketing materials, or official documents.
3. Content Standards for AI Interactions
When using Ace AI's conversational features, voice chat, email drafting, or any other content-generation capabilities, you agree that all content you generate, request, or distribute through the platform must:
- Be truthful, accurate, and not misleading.
- Comply with all applicable federal, state, and local laws and regulations, including but not limited to real estate licensing laws, fair housing laws, advertising regulations, and consumer protection statutes.
- Not contain or promote hate speech, discrimination, or content that targets individuals or groups based on protected characteristics.
- Not contain explicit, obscene, or sexually suggestive material.
- Not infringe on the intellectual property rights, privacy rights, or other legal rights of any third party.
- Not impersonate any person, business, or entity, or misrepresent your affiliation with any person or entity.
- Include appropriate disclosures when AI-generated content is used in client-facing communications, as required by applicable law or professional standards.
4. API and Integration Usage Limits
Your use of Ace AI's APIs, MCP tools, and third-party integrations is subject to the following conditions:
- Rate Limits: All API and MCP tool usage is subject to rate limits as determined by your subscription plan. Current rate limits are documented in your account settings and may be updated from time to time.
- Fair Use: API and integration usage must be consistent with normal, reasonable business use. Excessive or unusual usage patterns that degrade service quality for other users may result in temporary throttling or suspension.
- Follow Up Boss API: Your use of Ace AI's integration with Follow Up Boss is also subject to Follow Up Boss's own API terms and rate limits. You are responsible for ensuring compliance with both sets of requirements.
- MCP Token Usage: MCP authentication tokens are issued per user and per plan tier. Tokens must not be shared, redistributed, or used in a manner inconsistent with your subscription plan.
- Third-Party Services: When Ace AI interacts with third-party services (such as Zillow, Gmail, or Twilio) on your behalf, you are responsible for complying with the terms of service of those third-party platforms.
5. Reporting Violations
If you become aware of any violation of this AUP, or if you believe that any user is engaging in prohibited activity, we encourage you to report it promptly. You can report violations by:
- Emailing us at [email protected] with a detailed description of the violation, including any supporting evidence.
- Contacting your account administrator, who can escalate the matter to Moon Sherpa Labs.
All reports will be reviewed promptly and treated confidentially to the extent possible. We will not retaliate against any user who reports a violation in good faith.
6. Consequences of Violations
Moon Sherpa Labs reserves the right to investigate any suspected violation of this AUP and to take appropriate action, which may include, but is not limited to:
- Warning: Issuing a written warning to the user, identifying the specific violation and requiring immediate corrective action.
- Temporary Suspension: Suspending the user's access to some or all Ace AI features for a defined period of time while the violation is investigated or remediated.
- Feature Restriction: Restricting access to specific features, such as AI-generated communications, MCP tools, voice chat, or Ace Trove, that were involved in the violation.
- Account Termination: Permanently terminating the user's account and access to Ace AI, without refund, for severe or repeated violations.
- Legal Action: Pursuing legal remedies, including but not limited to seeking injunctive relief or monetary damages, for violations that cause harm to Moon Sherpa Labs, its users, or third parties.
- Reporting to Authorities: Reporting violations to appropriate regulatory authorities, law enforcement agencies, or real estate licensing boards when required by law or when we believe such reporting is warranted to protect the public interest.
The specific consequences will depend on the nature and severity of the violation, whether it is a first offense or a pattern of behavior, and the user's cooperation in resolving the matter. Moon Sherpa Labs will exercise reasonable judgment in determining the appropriate response, but reserves sole discretion in all enforcement decisions.
7. Changes to This Policy
Moon Sherpa Labs reserves the right to update or modify this AUP at any time. Changes will be posted on this page with an updated revision date. Your continued use of Ace AI after any changes indicates your acceptance of the revised policy. We encourage you to review this AUP periodically.
